Terms of Service
Please read these terms carefully before using our service. They govern your access to and use of MediCare HMS.

These Terms of Service (“Terms”) govern your use of the MediCare HMS website (medicarehms.com) and the Hospital Management System software (the “Service”) provided by MediCare HMS (“we,” “us,” or “our”). Consequently, by purchasing, accessing, or using the Service, you agree to be bound by these Terms.
1. Software License and Payment Terms
Lifetime License Agreement
Upon a one-time payment as specified on our Pricing page, we grant you a perpetual, non-exclusive, non-transferable license to use the Service in accordance with these Terms. It is important to note that this “lifetime license” is valid for the lifetime of the MediCare HMS product and is also subject to the termination clauses outlined in this agreement.
Payment
All payments are processed through our third-party payment processor. In addition, you agree to provide current, complete, and accurate purchase and account information for all purchases made.
2. User Account Terms and Responsibilities
It is your responsibility to maintain the confidentiality of your account and password, which includes restricting access to your computer. As a result, you agree to accept responsibility for all activities that occur under your account or password. Furthermore, all accounts must be registered by a human; accounts created by “bots” or other automated methods are not permitted.
3. Data Ownership in Our Hospital Management Software
Your Data
You retain all ownership rights to the data you input into the Service, including patient records, staff information, and financial data (“Your Data”). Indeed, we do not claim any ownership over Your Data. Our access to Your Data is limited to what is necessary to provide, maintain, and improve the Service, or as required by law.
Data Security and Compliance
Our Service integrates with Supabase to provide a secure backend. While we implement industry-standard security measures, you are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including but not limited to the Health Insurance Portability and Accountability Act (HIPAA). MediCare HMS is a tool; therefore, it is your responsibility to implement HIPAA-compliant procedures.
4. Acceptable Use Policy for Our Service
You agree not to use the Service for any unlawful purpose or to engage in any of the following prohibited activities:
- Attempting to reverse engineer, decompile, or otherwise discover the source code of the software.
- Using the Service to store or transmit infringing, libelous, or otherwise unlawful or tortious material.
- Interfering with or disrupting the integrity or performance of the Service or third-party data contained therein.
- Attempting to gain unauthorized access to the Service or its related systems or networks.
5. Intellectual Property Rights in Our Software
The Service, including its “look and feel” (e.g., text, graphics, images, logos), proprietary content, information, and other materials, are protected under copyright, trademark, and other intellectual property laws. Consequently, you agree that MediCare HMS owns all rights, title, and interest in and to the Service.
6. Limitation of Liability in These Terms
To the fullest extent permitted by applicable law, in no event shall MediCare HMS, its affiliates, directors, or employees, be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages. This includes, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, this Service.
7. Termination of this User Agreement
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, for instance, if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
8. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. However, what constitutes a material change will be determined at our sole discretion.
